Hey, not sure what state you live in, but, in Maryland, it could absolutely happen. You see, any property, even a retail establishment, that is not owned by a governmental entity is private property, and any civil contract between say a shopping center owner and a towing company, is valid and thus, the towing company is directed through their contract to enforce the towing of vehicles that the shopping center owner deems are not "customers", such as person who they watch walk off of the parking lot after parking there. It's more of a civil issue, but still answerable by any knowledgable Police Officer, as often I have responded to civil towing disputes on apartment complexes, shopping center parking lots, and occasionally on single family home private property where the home is located in an area that has a housing association with byrules that disallow parking in certain areas (townhouse properties). Anyways, yes, this can happen.
