Just asking if I can proceed with prosecuting a person who stole and did a helluva lotta damage to my zx12r. I initially didn't call the cops because I knew him and he didn't even make it 100ft. He has a daughter, he got banged up pretty good and I felt bad. He professed profusely that he'd pay for damages, but after I presented him with a bill in the better part of 2 grand... I haven't seen or heard back from him. It was against my better judgement, seeing as he DID take the bike without permission AND he was drunk, but now I want him to realize that he can't go around and do what he did. There were many witnesses, and I know that small claims court is an option... but now I'm more pissed than I was before. This all happened about 2-3 weeks ago... So, what can I do?

Im not 100% sure but I think its not for small claims court...I think small claims is for 500 bucks or under !! How close are you and your insurance company, I mean can you call them and talk to them about the situation...claim it on ur ins and then have them go after the guy that wrecked it ?? Just a thought

Naw... i'd rather not involve the insurance company. They have no problem upping my premiums even if it wasn't my fault. I just had two No-Fault accidents come off. Thanx for the quick reply, tho... do you know if it's too late to involve the authorities?

I THINK SMALL CLAIMS IS HIGHER THAN $500, HERE IT'S LIKE $5000. I'D CHECK WITH YOUR LOCAL CLERK OF THE COURT. AS FAR AS CALLING IT IN THAT SHOULD HAVE BEEN DONE A LONG TIME AGO, YOUR ONLY CHOICE NOW IS TO TAKE HIM TO COURT, TURN IT IN ON YOUR INSURANCE, OR MY PERSONAL FAV DRIVE OVER TO HIS HOUSE PULL HIM OUT IN HIS YARD AND BEAT HIM WITH A PIECE OF YOUR NOW TRASHED BIKE ! vader, check with your local PD but I'm fairly certain anything punative must come through civil court, i.e., you could charge him with taking w/o owners consent but the municipal court can not levy repayment for your damages. I believe this can only be done in a civil court.

Thanx alot everyone for the helpful advice... although MadCow had the best answer, i believe lol! Naw... just kiddin'. I guess i'll talk to a couple cop friends and get in touch with the town clerk. I'll let ya all know how it oans out. p.s. anyone know of some good companies for plastics, oem or even race bodies. i heard pit-tek was garbage, air-tech was a lil better, but i also found a body from War Eagle... don't know much about their product. FYI*** In New York City, Small Claims cases are heard in City Civil Court; in Nassau and Suffolk Counties in District Court, except 1st District; in other cities in City Court. In rural areas, cases are heard in Justice Court. you will want to see the "court clerk". she should have the needed forms for you fill out. |

whenever I have people drinking at my house, I always hide the keys to my bike. For some reason people like starting the 12R so they can rev it up and hear the symphony that it provides. This also keeps prople from taking any joy rides

Should have filed charges when it happened. I'm sure you are still in the statute of limitations. It could be done, but it is up to you local cops. Might want to check with your DA office to see if they would accept charges. If they won't then you only have a civil case.
